These terms apply to the Smart POS desktop software, its installer and updates, its free trial, its license activation and online license check, and the Smart POS website and license request service (together, the "Software"). By installing, starting a trial of, activating or using the Software, you ("you", the shop or business using the Software) agree to these terms. If you do not agree, do not install or use the Software.
Part A — Terms of Use
1. The license
1.1 The Software is licensed, not sold. We remain the owner of the Software and all of its rights.
1.2 A license lets one shop use the Software on one computer. Each license is tied to the computer it was issued for (see section 4). To use the Software on more computers, you need a license for each.
1.3 License plans are Lifetime, 1 Year, 6 Months, 3 Months and Monthly. A time-limited license stops working on its expiry date unless it is renewed. A Lifetime license has no expiry date, but it remains subject to these terms (including section 11).
1.4 A license may not be sold, rented, lent, shared or transferred to another shop or person without our written agreement.
2. What you may not do
You may not, and may not allow anyone to:
- copy, modify, translate or create works based on the Software, except for your own backups of your data;
- reverse engineer, decompile or disassemble the Software, except where the law clearly allows it;
- bypass, disable or tamper with the license, trial, online check or any security feature, or use a license, key or activation that was not issued to you by us;
- remove our name, notices or branding;
- use the Software for any unlawful purpose, or to store or process data you are not legally allowed to hold.
3. Free trial
3.1 A new installation includes a 7-day free trial. The trial is for evaluation.
3.2 When the trial ends, the Software becomes read-only until a license is activated: you can still open and view your saved data and reports, but you cannot make sales or change records. Data you entered during the trial stays on your computer and is fully usable once you activate a license.
3.3 One trial is offered per computer. Attempting to restart or extend a trial by deleting files, changing the clock or similar means is not allowed.
4. Activation, computer identity and online check
4.1 To issue and check a license, the Software creates a computer identifier: a one-way fingerprint (SHA-256 hash) made from your computer's hardware identity (normally the motherboard, otherwise the Windows disk or Windows installation). The fingerprint cannot be turned back into your hardware details.
4.2 A license works only on the computer whose identifier it was issued for. If you replace the computer or its motherboard, or reinstall Windows in a way that changes the identifier, contact us to move your license. We may ask for proof of purchase.
4.3 When the computer is connected to the internet, the Software contacts our license server about once a day (an "online check"). The Software continues to work for up to 29 days without internet; after that it becomes read-only (saved data can still be viewed) until one online check succeeds.
4.4 Our server may answer that a license is blocked, expired or not registered. In that case the Software becomes read-only (saved data can still be viewed) until the matter is resolved. We block a license only for a reason listed in section 11, and you may contact us about any block.
5. Fees, payment and refunds
5.1 License fees are those agreed with you at the time of purchase. Fees are payable in advance.
5.2 Refunds: you may request a refund within 7 days of activating your first license if the Software cannot be made to work on your computer and our support could not resolve the problem. Contact us within that period and allow us a reasonable opportunity to help. An approved refund is paid back through the original payment method within 14 days, and the refunded license is deactivated.
5.3 Refunds are not given: after the 7-day period; for renewals or extensions of a license; for a change of mind after the Software has worked as described; for licenses blocked under section 11; or for problems caused by your computer, operating system, other software, devices or internet connection that are outside the Software.
5.4 Renewal of a time-limited license is your responsibility; we may remind you, but an expired license stops working on its expiry date.
6. Your data and backups
6.1 Your business data stays on your computer. Products, stock, sales, purchases, customers, suppliers, khata (credit), cash book, expenses, employees and settings are stored in a database on your computer. We do not receive, view or store this data (see Part B for the limited shop details we do receive).
6.2 You are responsible for backing up your data. The Software offers local backups, scheduled backups, encrypted backups and optional Google Drive backups. Keep backups on a separate disk or device and test that they open. We are not responsible for data lost through hardware failure, theft, viruses, deletion, a lost backup password, or failure to keep backups.
6.3 If you encrypt backups, keep the backup password safe. Without it, an encrypted backup cannot be opened by you or by us.
6.4 The Software keeps an activity log (who did what, such as edits, deletions, price and stock changes, payments and sign-ins) on your computer for 30 days, then removes older entries automatically. Sales, stock and khata records are not removed by this.
6.5 You are responsible for the personal data of your own customers, suppliers and staff that you enter into the Software, and for handling it lawfully.
7. Your responsibilities
- Enter correct prices, taxes, quantities and records, and check the totals, reports and receipts the Software produces. The Software is a tool; you remain responsible for your business records.
- Tax compliance is yours. Tax rates, FBR integration settings and the invoices you report are your responsibility. Configure them as your tax adviser instructs.
- Keep user accounts, passwords and administrator access secure, and give staff only the permissions they need.
- Keep your computer secure, updated and free of malware, and use a genuine copy of Windows.
8. Updates and support
8.1 We may release updates. The Software tells you when an update is available; it is downloaded and installed only when you choose. Updates may change, add or remove features.
8.2 We may stop providing updates or support for older versions. A version you already use keeps working under its license, but online checks need a version we still support.
8.3 Support is available 24 hours a day, 7 days a week by phone, WhatsApp and email, using the contact details at the top of this document. We respond as quickly as we reasonably can; response and resolution times may vary with the nature of the problem.
9. No warranty
To the extent the law allows, the Software is provided "as is" and "as available". We do not warrant that it will be free of errors or interruptions, that it will meet every requirement of your business, or that it will work with every computer, printer, scanner, scale or other device. We will make reasonable efforts to fix errors you report.
10. Limitation of liability
10.1 To the extent the law allows, we are not liable for any indirect or consequential loss, including loss of profit, sales, data, goodwill or business interruption, or for tax penalties, however caused.
10.2 Our total liability for any claim relating to the Software is limited to the license fees you paid us for that computer in the 12 months before the claim.
10.3 Nothing in these terms limits liability that cannot be limited by law.
11. Suspension and termination
11.1 We may block or end a license if: the license fee was not paid or a payment was reversed; the license was obtained by fraud or misrepresentation; the license is used on a computer it was not issued for, or shared; or these terms are seriously broken. Where reasonable, we will contact you first.
11.2 You may stop using the Software at any time. Fees already paid are refundable only under section 5.2.
11.3 When a license ends, the Software becomes read-only, but your data stays on your computer and in your backups. You may keep it, view it and export it.
12. Changes to these terms
We may update these terms, for example when the Software changes. The current version is published on our website and included with each installer. Significant changes will be shown in the Software or on our website before they take effect. Continued use after that means you accept the updated terms.
13. Governing law
These terms are governed by the laws of the Islamic Republic of Pakistan. The courts at Layyah, Punjab have jurisdiction over any dispute, without limiting any right you have to apply to another court under law.
Part B — Privacy Policy
14. What we receive, and when
We receive only the following. We never receive your sales, stock, purchases, customers, suppliers, khata, cash book, expenses, employees, prices, passwords or backups.
| When | What we receive |
|---|---|
| Online license check (licensed computers, about once a day) and trial check-in (computers on trial, about once a day) | Shop name, owner name, shop phone, administrator email, shop address and business type as entered in the Software's settings; the computer identifier (section 4.1); the app version; for a licensed computer, a one-way reference (hash) of the license; for a trial, its start and end dates; the date and time of each check. Like any internet service, our server also sees the computer's internet (IP) address. |
| License request from the Software or our website | The details you type in the form: your name, shop name, phone, email, address, business type, chosen plan and notes, and the computer identifier. |
| Contact or inquiry from our website | The details you choose to send us. |
15. Why we use it
- to issue, activate, verify, renew, move or block licenses, and to prevent misuse and unlicensed copies;
- to know which shops use or are trying the Software, so we can provide support and contact you about your license, trial, renewal or important updates;
- to keep our service secure (for example, to limit abuse of the license service). We do not sell your information and do not use it for third-party advertising.
16. Where it is kept and who can see it
16.1 This information is stored on our license server, hosted by Cloudflare (Cloudflare Workers and D1 database), and in our License Manager software, used only by Prime Coder Technologies and staff we authorise.
16.2 We share it only: with service providers who host or run our services for us, under their own data protection obligations; when required by law or a lawful request of an authority; or with your consent.
16.3 We keep license and online check records while the license is active and for 2 years after it ends; trial check-in records for 1 year after the trial's last check-in; and license requests and inquiries that do not lead to a license for 1 year; unless the law requires longer. You may ask us to delete trial or inquiry records earlier.
17. Services you choose to use
These features connect to other services only when you turn them on. Those services' own terms and privacy policies apply to them.
- Google Drive backup: backups are uploaded to your own Google account. The Software asks only for access to the files it creates (Google "drive.file" access) and your email address to show which account is connected. We do not receive your Google sign-in or your backups.
- Daily email report: reports are sent from the mailbox you configure, to the recipients you choose.
- WhatsApp receipts and reminders: the Software opens WhatsApp with the message filled in; you send it.
- FBR integration: when you enable it, invoice data is sent to the Federal Board of Revenue's system as your settings require.
- Software updates and downloads: installers are downloaded from our public GitHub release page (GitHub sees the download request).
18. Your choices and rights
- You decide which shop details to enter in the Software's settings; these are what the online check and trial check-in send.
- You may ask us what information we hold about your shop, ask us to correct it, or ask us to delete records we no longer need (we may keep license records needed to prevent misuse or required by law).
- Contact us using the details at the top of this document.
19. Security
We use encrypted (HTTPS) connections, signed license answers and access controls on our license server and License Manager. No system is perfectly secure; we will tell affected shops without undue delay if we learn of a breach that affects their information.
20. Children
The Software is a business tool and is not intended for use by children.
21. Changes to this policy
We may update this policy as described in section 12. The effective date at the top shows the latest version.
